1. Acceptance of Terms
Welcome to Crushie ("App", "Service"). These Terms of Service, together with our Privacy Policy and End User License Agreement ("EULA"), constitute a legally binding agreement between you and Crushie. By downloading, installing, registering, accessing, or using Crushie, you agree to be bound by these terms. If you do not agree to these terms, do not access or use the App.
2. Eligibility and Account Security
Crushie is intended for personal, non-commercial use by individuals who are at least 17 years old. By registering, you confirm that you meet this age requirement and have the legal capacity to enter into these terms. You are responsible for safeguarding your login credentials (via Apple Sign-in or Email) and for all activities that occur under your account.
3. Private Couple Space & User Content
Crushie enables you and your paired partner to share private notes, photos, couple memories, daily Q&A responses, and messages within your dedicated couple space.
Ownership: You retain full ownership and intellectual property rights in the content and photos you create or submit. By uploading content, you grant Crushie a worldwide, non-exclusive, royalty-free, limited license to host, store, transmit, and display your content solely for the purpose of operating, delivering, and improving the app features for you and your partner.
4. Community Standards & Zero Tolerance for Objectionable Content (EULA)
There is zero tolerance for objectionable, harmful, or abusive content and behavior. In compliance with App Store safety guidelines, you agree NOT to upload, post, transmit, or share any content that:
- Is unlawful, defamatory, libelous, fraudulent, obscene, sexually explicit, or pornographic.
- Depicts sexual violence, non-consensual sexual content, or child sexual exploitation and abuse (CSAM).
- Promotes hate speech, violence, discrimination, or harassment against any individual or protected group.
- Infringes upon the intellectual property, privacy, or publicity rights of any third party.
- Contains malicious code, viruses, automated bots, scrapers, or security circumvention tools.
We reserve the right to review, restrict, filter, or immediately delete any content and terminate or suspend accounts that violate these safety standards without prior notice.
5. Content Moderation & Reporting Mechanisms
To maintain a safe environment, Crushie provides tools for partners to manage their experience:
- You may clear chat messages, remove partner bindings, or delete your space at any time directly within the app settings.
- If you encounter objectionable content, abusive conduct, or terms violations, you can immediately report the issue to our safety team at support@crushie.me. We review and act upon reports within 24 hours.
6. Device Permissions and Features
Certain features in Crushie require permissions for camera access, photo library access, location services, or push notifications. Permissions are optional, but denying them may limit the corresponding functionality (such as photo sharing or notification alerts). You may revoke permissions at any time via iOS Settings.
7. Intellectual Property Rights
The Crushie app, software, design, user interface, brand assets, logos, visual graphics, animations, code, and trade dress are the exclusive property of Crushie and its licensors, protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these terms grants you any right to copy, modify, distribute, reverse engineer, or decompile the software.
8. Third-Party Services and In-App Purchases
The App may integrate third-party services and APIs (e.g., Apple Sign-In, Firebase, Adjust). If optional in-app purchases, subscriptions, or digital items are offered, billing, payment processing, renewals, and cancellations are governed by Apple Media Services Terms and Conditions.
9. Disclaimer of Warranties
Crushie is provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
10. Limitation of Liability
To the fullest extent permitted by law, Crushie, its developers, affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of goodwill, device failure, or personal disputes, resulting from your access to or use of (or inability to use) the App.
11. Termination
You may terminate this agreement at any time by stopping use of Crushie, deleting your couple space in the app settings, and uninstalling the application. We may suspend or terminate your access immediately if you breach these terms or if required by law.
12. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without giving effect to any conflict of law principles. Any dispute arising from these terms shall be resolved through good-faith informal consultation or competent courts.
13. Changes to Terms
We may amend these Terms of Service from time to time. We will indicate the update date at the top of this document. Continued use of the App following any update constitutes your agreement to the modified terms.
